1. PURPOSE
The purpose of these general terms and conditions of sale is to define the rights and obligations of Deloison Paris and the Customer in connection with the sale of products presented on the website www.deloison-paris.com (hereinafter the “Website”).
These terms apply exclusively between SAS Victoire Deloison, a simplified joint-stock company with a share capital of 1,000 euros, whose registered office is located at 9 rue Buffault, 75009 Paris, registered with the Paris Trade and Companies Register under number 853 612 216, with intra-Community VAT number FR 91 853 612 216 (hereinafter “Deloison Paris”),
and any natural person of legal age acting as a consumer, visiting or making a purchase via said Site (hereinafter the “Customer”).
On the Site, Deloison Paris allows the Customer to order online jewelry creations and products from the Deloison Paris brand (hereinafter the “Product(s)”), under the terms and conditions set forth in these General Terms and Conditions of Sale.
Any order placed on the Site implies the Customer’s full and unconditional acceptance of these general terms and conditions of sale.
Deloison Paris reserves the right to modify these general terms and conditions of sale at any time. The applicable terms and conditions are those in effect on the date the Customer places the order.
These general terms and conditions of sale are available at all times on the Site in a format that allows them to be viewed, printed, and downloaded, so that the Customer may retain a permanent copy.
2. CUSTOMER OBLIGATIONS
2.1.
The Customer declares that they are at least 18 years of age and have the legal capacity to place an order on the Website. If applicable, they declare that they have parental consent authorizing them to do so.
2.2.
The Customer agrees to provide Deloison Paris with accurate, complete, and up-to-date information necessary for the processing and delivery of their order, including their last name, first name, mailing address, phone number, and valid email address.
The Customer is solely responsible for any consequences resulting from incorrect, incomplete, or inaccurate information provided during the ordering process, particularly in the event of a delay or inability to deliver.
2.3.
Once the order is confirmed, Deloison Paris will send the Customer a confirmation email summarizing the key details of the order. The Customer will be notified by email when the order is shipped, if applicable.
2.4.
The Customer may access their personal account on the Website at any time and update their information via the “My Account” section.
3. PRODUCTS
3.1.
The Products offered for sale on the Site are those listed on the Site on the day the Customer views them, subject to availability or manufacturing capacity.
Each product is presented on the Site in the form of a product description page that includes, in particular, photographs, a detailed description, and the essential characteristics of the Product, in accordance with Article L111-1 of the French Consumer Code.
3.2.
The photographs, images, and descriptions of the Products are provided for informational purposes only and are intended to represent the Products offered for sale as accurately as possible.
However, due in particular to screen settings, technical constraints of photography, and the artisanal nature of the creations, slight variations in color, shape, weight, or dimensions may occur, for which Deloison Paris cannot be held liable.
3.3.
As Deloison Paris creations are handcrafted, certain characteristics—particularly the weight of precious metals or gemstones—may vary slightly depending on the size, ring size, or specifications chosen by the Customer.
These variations in no way affect the quality or value of the Product.
3.4.
Certain Products may be custom-made or personalized at the Customer’s request (including engraving, specific sizing, or stone selection).
These personalized or custom-made Products are expressly identified as such on the Site.
4. ORDER
4.1.
Any order placed on the Site becomes firm and final only after the Customer has confirmed payment and Deloison Paris has sent an order confirmation email summarizing the essential details of the order.
Unless otherwise required by law, no modification or cancellation of an order is possible after the order has been validated and confirmed by email, particularly for Products made to measure or customized at the Customer’s request.
4.2.
Deloison Paris reserves the right to refuse or cancel any order placed by a Customer with whom there is a dispute regarding payment for a previous order or in the event of an obvious anomaly concerning the order.
4.3.
Orders are accepted subject to available stock or manufacturing capacity. Product availability is indicated on the Website at the time the order is placed.
In the event that an ordered Product is unavailable, either permanently or temporarily, Deloison Paris will notify the Customer by email as soon as possible. The Customer may then, if applicable, cancel their order and receive a refund of any amounts already paid.
The unavailability of a Product shall not give rise to any liability on the part of Deloison Paris, nor shall it entitle the Customer to any compensation or damages.
5. PRICES
The prices of products displayed on the Site are indicated in euros, inclusive of all taxes (TTC), including the value-added tax (VAT) applicable in France and, where applicable, in European Union countries, excluding shipping costs.
Delivery costs, as well as any order processing and packaging fees, are clearly and in detail shown to the Customer in the shopping cart before the final confirmation of the order.
Deloison Paris reserves the right to modify its prices at any time, particularly in the event of changes in tax regulations, economic conditions, or the cost of raw materials.
However, Products are invoiced based on the rates in effect at the time the order is placed.
6. DELIVERY
Deloison Paris delivers its Products in France and within the European Union. Deliveries outside the European Union may be offered upon prior request by the Customer.
Products are shipped to the delivery address provided by the Customer when placing the order. Delivery cannot be made to hotels or P.O. boxes.
The Customer agrees to provide accurate, complete, and up-to-date information regarding the delivery address (including: street number and name, building, floor, access codes, name on the mailbox, and phone number).
The delivery times indicated on the Site are provided for informational purposes only. They correspond to the average time required for manufacturing, preparing, and shipping the products. For custom-made or personalized Products, delivery times may be longer and are specified at the time of order.
In the event of a delivery delay, the Customer will be notified as soon as possible. In accordance with applicable regulations, the Customer may request cancellation of the order after a written notice of default has gone unanswered, and obtain a refund of the amounts paid.
If the product has been shipped before receipt of the cancellation request due to a delivery delay, Deloison Paris will refund the cost of the product as well as the delivery and return shipping costs upon receipt of the returned product in its original condition.
Deloison Paris undertakes to keep the Customer informed of the progress of the processing and shipment of their order.
In the event of delivery of a package that is clearly damaged (open package, missing or damaged products), the Customer agrees to file all necessary claims with the carrier and to notify Deloison Paris, by any means, within 3 days of receiving the package.
Deloison Paris shall not be held liable for delivery delays attributable exclusively to the carrier or resulting from circumstances beyond its control.
7. PAYMENT
Payment for the order is due in full at the time the order, unless otherwise specified for custom-made Products, for which a deposit may be required and specified during the ordering process.
The Customer may pay for their order by credit card (Visa, Mastercard), via an account, Apple Pay, or Google Pay, depending on the payment methods offered on the Site at the time of the order.
Deloison Paris does not accept payments by check. No cash-on-delivery shipments will be accepted, for any reason whatsoever.
For credit card payments, the Customer must provide their card number, expiration date, and security code, in accordance with current security standards.
Providing this information constitutes authorization for Deloison Paris to charge the Customer’s account for the total amount of the order.
Payments made on the Site are fully secure thanks to payment systems that comply with current security standards. The Customer’s banking information is not are not stored by Deloison Paris at any time.
Deloison Paris retains full ownership of the Products sold until the Customer has paid the full price.
PAYMENT IN 3 INSTALLMENTS WITH ALMA
The Customer has the option to pay for their order in 3 installments at no extra cost by credit card, via the secure Alma payment solution, subject to eligibility.
This payment method is available for orders that meet the conditions defined by Alma and requires the Customer’s acceptance of Alma’s terms and conditions of use, which are accessible during the payment process.
Payment in installments is made through a credit facility provided by Alma. As such, Alma is solely responsible for managing the installment payments. Deloison Paris does not intervene at any stage in the approval or denial of this payment method.
By choosing to pay in 3 installments, the Customer authorizes Alma to collect the installments according to the schedule provided upon order confirmation.
In the event of a missed payment, Alma reserves the right to refuse any new installment payments.
*For custom-made products, a 30% deposit of the total amount due will be required from the customer.
8. RETURNS AND REFUNDS – RIGHT OF WITHDRAWAL
8.1. Right of Withdrawal
In accordance with the provisions of Articles L221-18 et seq. of the French Consumer Code, the Customer has a legal period of fourteen (14) days from the date of receipt of their order to exercise their right of withdrawal, without having to provide a reason for their decision.
To exercise this right, the Customer must notify Deloison Paris of their decision to withdraw in writing (via email or mail) before the expiration of the statutory period.
8.2. Customized Products – Special Exchanges
In accordance with Article L221-28 of the French Consumer Code, Products made to measure or personalized at the Customer’s request (including engraving, specific sizing, or a particular choice of stone or finish) are not subject to the right of withdrawal and, in principle, cannot be returned, exchanged, or refunded.
However, on an exceptional basis, Deloison Paris may consider a request for an exchange or modification of a personalized Product on a case-by-case basis, depending on the nature of the work performed and the technical feasibility of the modification.
Such acceptance remains entirely at our discretion and in no way constitutes an obligation on the part of Deloison Paris.
Any costs associated with the modification, restoration to compliance, or remanufacture of the Product may, where applicable, be borne by the Customer and will be subject to a prior estimate.
No exchange or modification may be demanded if the requested modification is technically impossible or likely to impair the quality, safety, or integrity of the Product.
8.3. Return Policy
Returned Products must be sent back in their original condition, complete, new, unworn, unused, and in their original packaging, accompanied by all applicable accessories and documents provided.
Product returns are made at the Customer’s risk. Return shipping costs are the Customer’s responsibility, except in the case of a defective or non-compliant Product.
8.4. Refund
In the event of a valid exercise of the right of withdrawal, Deloison Paris will refund the amounts paid by the Customer, excluding return shipping costs, within a maximum of fourteen (14) days from receipt of the returned Products or proof of shipment thereof.
The refund will be issued via the same payment method used for the order, unless the Customer expressly agrees to a different method.
If the aforementioned return conditions are not met, Deloison Paris reserves the right to refuse to refund the Products in question.
9. WARRANTIES AND LIABILITY
9.1. Liability Related to Use of the Site
Deloison Paris takes all reasonable measures to ensure access to, the operation of, and the security of the Site.
However, Deloison Paris shall not be held liable for any inconvenience or damage inherent in the use of the internet, particularly in the event of service interruption, technical failure, external intrusion, the presence of computer viruses, or any other event classified as force majeure under French law and case law.
9.2. Liability Related to Products
Deloison Paris shall not be held liable for any damage resulting from misuse, lack of maintenance, or improper use of the Products by the Customer.
Deloison Paris shall in no event be liable for indirect, immaterial, or unforeseeable damages, such as, but not limited to, loss of opportunity, loss of business, or commercial loss.
In any event, and to the extent permitted by law, Deloison Paris’s liability is strictly limited to the amount of the order in question.
9.3. Statutory Warranties
Regardless of any commercial warranty that may be offered by Deloison, the Customer is entitled to the legal warranties provided for by current French law, namely:
The statutory warranty of conformity, in accordance with Articles L.217-3 et seq. of the French Consumer Code; The statutory warranty against hidden defects, in accordance with Articles 1641 et seq. of the French Civil Code.
Legal warranty of conformity, the seller is required to deliver a Product that conforms to the contract and is liable for any lack of conformity existing at the time of delivery of the Product.

The Product is considered to be in conformity, in particular, when it:

Corresponds to the description provided and possesses the qualities presented to the Customer;

Is fit for the purpose usually expected of a similar item;

Possesses the characteristics agreed upon by the parties or is fit for the specific purpose sought by the Customer, which has been brought to the attention of Maison Deloison and accepted by it.
When the Customer acts under the legal warranty of In accordance with the law, it provides:

A period of two (2) years from the date of delivery of the Product to take action;

The choice between repair or replacement of the product, subject to the conditions provided by law.

Warranty against hidden defects
Maison Deloison is also liable under the warranty for hidden defects in the Product that render it unfit for its intended use or that so impair such use that the Customer would not have purchased it, or would have paid only a lower price for it, had they been aware of such defects.
Any claim arising from hidden defects must be brought by the Customer within two (2) years of the discovery of the defect.
Exclusions
Statutory warranties do not cover damage resulting from:

Abnormal or improper use of the Products;

Impacts, drops, pressure, or external forces;
-
Defects in maintenance or handling;
-
The loss or breakage of stones and pearls due to external causes.
These situations may be subject to a repair estimate, subject to the Customer’s prior approval.
10. PERSONAL DATA
Personal data is processed in accordance with the privacy policy available on the website.
11. GENERAL PROVISIONS
11.1. Partial Invalidity
If any provision of these General Terms and Conditions of Sale is declared invalid, illegal, or unenforceable by a court of competent jurisdiction, it shall be deemed unenforceable, without affecting the validity, legality, or enforceability of the remaining provisions.
11.2. Updates to the General Terms and Conditions
DELOISON reserves the right to modify these General Terms and Conditions of Sale at any time.
The applicable General Terms and Conditions are those in effect on the date the Customer confirms the order.
These General Terms and Conditions of Sale are permanently available on the DELOISON website in a format that allows them to be viewed, printed, and downloaded, so that the Customer may retain a copy.
11.3. Governing Law – Jurisdiction
These General Terms and Conditions of Sale are governed by French law, both in terms of substantive and procedural rules.
In the event of a dispute, the Customer is invited to contact DELOISON to seek an amicable resolution.
If an amicable settlement cannot be reached, the dispute will be brought before the competent French courts, in accordance with the rules of common law.
12. AMENDMENTS TO THE TERMS AND CONDITIONS
Deloison Paris reserves the right to amend these Terms and Conditions at any time.
